1. revocation instruction for consumers (uniform delivery)

Consumers is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

Right of withdrawal

Consumers have the right to withdraw from a contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which the consumer or a third party named by the consumer, who is not the carrier, has taken possession of the goods.

To comply with the withdrawal period, it is sufficient that the notification of the exercise of the right of withdrawal is sent before the expiry of the withdrawal period.

Consequences of the revocation

In the event of an effective withdrawal, all payments, including delivery costs (with the exception of additional costs resulting from a different shipping method chosen by the consumer), must be refunded immediately and at the latest within fourteen days of receipt of the declaration of withdrawal.

The same means of payment that was used for the original transaction will be used for the refund, unless expressly agreed otherwise. Under no circumstances will the consumer be charged any fees for the repayment.

Special feature for credit card payment: In the case of payments by credit card, refunds are made automatically via the same payment service provider and to the same credit card account. A refund to another account is not possible for technical reasons. In individual cases, it may be necessary to provide additional information (e.g. full cardholder name or enquiry about the transaction number) so that the payment service provider can correctly allocate the refund. In such cases, we will contact the customer in good time.

To facilitate processing, we therefore ask you to provide as much information as possible about the original order in the declaration of revocation belowin particular name, order number and means of payment used.

Repayment may be withheld until receipt of the goods or proof of return, whichever is the earliest. The goods must be returned to Hemmy's immediately and at the latest within fourteen days of the declaration of revocation. The deadline is met if the goods are dispatched before the deadline expires. The direct costs of returning the goods shall be borne by the consumer.

Compensation must only be paid for any loss in value of the goods if this loss in value is due to handling that is not necessary for checking the quality, properties and functionality of the goods.

Notes on returning goods

Reasons for return (specify code number):

1 - Transport damage
2 - Breakage or damage
3 - Incorrect delivery or deviation from the ordered item
4 - Product does not correspond to the description
5 - Defects in appearance, odor or workmanship
6 - Other (please explain)

Explanation of the reason for return: The reason for the return should be described as specifically as possible. In the case of damaged goods or transport damage, additional photo documentation is required.

Other notes:

Returns should as safe as possible for transportation especially for sensitive goods such as cigars or spirits. For The consumer is liable for transport damage unless this is due to improper delivery by Hemmy's.
In the case of credit card payments, the refund will be made to the original means of payment used. Depending on Depending on the payment method, special conditions may apply and further information may be required for refunds, especially for credit card payments. In this case we will contact you directly. Please provide as much information as possible.
Returns must be fully traceable. We ask for as complete information as possible and a signed copy of the original invoice or order confirmation. Incomplete, late or improperly packaged returns may lead to a delay in reimbursement. The costs of the return shipment shall be borne by the consumer, provided there is no defect on our part.
The right of withdrawal may be excluded for individual orders, sealed goods, opened luxury foods or products manufactured according to customer specifications (see section 3 of these instructions).

3. exclusion or premature expiry of the right of withdrawal

The right of withdrawal does not apply to contracts:

for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive;
for the delivery of goods that can spoil quickly or whose expiration date would be quickly exceeded;
for the delivery of alcoholic beverages whose price was agreed upon conclusion of the contract, but which are delivered no earlier than 30 days after conclusion of the contract and whose value is subject to market fluctuations;
for the delivery of newspapers, magazines or periodicals, with the exception of subscription contracts.

The right of withdrawal expires prematurely for contracts:

for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene, if their seal was removed after delivery;
for the delivery of goods that have been inseparably mixed with other goods after delivery.

Special revocation regulations depending on the type of contract

Several goods delivered separately: The period begins upon receipt of the last goods.
Partial deliveries or denominations: The period begins upon receipt of the last partial shipment.
Regular delivery over a fixed period: The period begins upon receipt of the first goods.

Premature expiry of the right of withdrawal

Your right of withdrawal expires prematurely if we have started to execute the contract after:

you have expressly consented to us commencing performance before expiry of the withdrawal period,
and you have confirmed your knowledge that you lose your right of withdrawal by giving your consent.
